Check 21

The Check Clearing for the 21st Century Act…a new way of clearing checks.

On October 28, 2003, President Bush signed into law the Check Clearing for the 21st Century Act, also known as “Check 21.” This new legislation became effective October 28, 2004.

Simply put, “Check 21” encourages banks to exchange digitized check images electronically rather than transporting the physical checks to the paying banks. The Act facilitates electronic check clearing by authorizing the use of a new negotiable instrument called a substitute check. This substitute check will be created from an electronic image of the original check, and will have the same legal standing for all purposes.
